ASUU Strike: Court Drops NANS Suit Against Varsity Lecturers, Demanding they Resume

The National Industrial Court in Abuja has dismissed a suit filed by Umar Lawal, President of the National Association of Nigerian Students NANS, requesting that the Academic Staff Union of Universities end its seven-month strike and return to school.


Lawal filed the suit on behalf of himself and the association.


On Tuesday, Justice Polycarp Hamman dismissed the suit after Lawal's counsel, Debo Ikuesan, withdrew the suit on the grounds that the student body is challenging his position as president, denying that he is the leader of NANS as he had deposed.


Marshal Abubakar, ASUU's counsel, also informed the court that he will not oppose the application to withdraw the suit.


In the suit, Faruk, who claimed to be the president of NANS, asked the court to order ASUU to end the strike that began in February 2022.


He claimed that the strike violates students' right to an education under Section 18, Chapter 2 of the 1999 constitution as amended. He also stated that the prolonged strike has harmed Nigerian students by causing them to lose valuable time and opportunities in their educational and career pursuits.


They are asking the court to order ASUU to end its strike, among other things.


They are also seeking a court order prohibiting ASUU and its members from engaging in or participating in the industrial action they initiated.


Sunday Asefon, the outgoing President of the Student Body, had approached the court, claiming that Umar Lawal did not have the mandate of NANS to initiate the action.


He claimed that Umar Lawal ran for and lost the position of National President of NANS.


Due to the Student's body's objection, counsel for Umar Farouk sought an order to dismiss the case, which ASUU's counsel, Mister Abubakar Marshall, did not oppose.
